QUEENS, N.Y. - The driver of a taxi that struck and killed a woman in Queens back in February won't be facing criminal charges.

The cab hit Sherena Hundalani at the corner of 63rd Road and Queens Boulevard in what was initially thought to be a hit and run.

Investigators later found that the driver, Lakhvinder Singh, suffered a sudden medical episode while behind the wheel.

Singh's TLC license has since been suspended and the city says he's no longer a licensed cabbie. 

But the victim's family still wants him to be prosecuted.

"To kill somebody is a crime, no matter what, if you're not able to manage your bike or your car you should not be on the street," said Prakash Hundalani, the victim's father.

"In our view if he was conscious and he knew what he was doing and he operated his vehicle in a grossly reckless manner, grossly negligent manner then there should be a prosecution," said Edward Paltzik, the family's attorney.

The family is now suing the Taxi and Limousine Commission and the Department of Transportation as they push for changes to city policy.
