An immigration judge granted a jailed Staten Island father a stay from being deported hours after NY1’s exclusive report aired about the family’s plea.

Six-year-old Aliya Gomez and her mother have been distraught since Immigration and Customs Enforcement authorities arrested and jailed Gomez’s father Julio Patricio in October.

The 37-year-old fled Ecuador with his family when he was 16 and crossed the southern border. He missed a court date for his asylum case and was ordered deported. Advocates say he was picked up and jailed after applying for a driver’s license.

Make the Road NY, a nonprofit organization that helps immigrant and working-class New Yorkers, is appealing his deportation.

And now the Board of Immigration Appeals says Gomez won’t be deported until that appeal is heard.

His family is now asking that he be released from jail while he awaits the results.
