NEW YORK - Debris fell from a building near Times Square, killing a woman below, authorities have confirmed. Now, the Department of Buildings (DOB) says that structure had an open violation.

Officials say 60-year-old Erica Tishman was walking on 7th Avenue near 49th Street Tuesday morning when a piece of the building struck her.

She was found with trauma to her head, and pronounced dead at the scene, the FDNY said.

Witnesses described the chaos, as people rushed to help.

"All I seen was, like, the top of hair. I didn't really get to see her whole body,” one witness nearby said. “The same way people are surrounding me now, there were people surrounding her trying to help her.”

The DOB says back in April, the building's owner was issued a violation and a fine of more than $1,200 for failing to maintain the facade.

That violation remains open to this day, because officials say the owner has not filed with the department that the violations have been fixed.

The DOB ordered the property owner to put up protective scaffolding on the site during the investigation.
