NEW YORK - A disciplinary trial will be held for the New York City Police Department officer who put Eric Garner in a deadly chokehold in 2014.

Officer Daniel Pantaleo was present for the decision at a public hearing Thursday at police headquarters in Lower Manhattan.

Garner's mother Gwen Carr was also in attendance.

Pantaleo used the banned chokehold while Garner was being arrested for selling loose cigarettes.

Garner's family says it's an outrage that the defense tried to delay the trial at Thursday's hearing. 

A grand jury declined to indict the officer four years ago.

Pantaleo's 10-day trial is scheduled to begin on May 13.
