New York Sports Club has their members sweating, not in the gym, but in their wallets.

"So I got charged 80 dollars," said member Makita Ellis.

"I saw the 69.99 and it made me livid," added member Marcy Lovitch.

Those are the varying rates for a monthly membership.

The gym chain has continued to charge its thousands of members monthly dues, despite all 53 of their locations being shut down since March 16th.

Part of a state mandate to slow the spread of the coronavirus.

"New York Sports Club has famously bad customer service so unfortunately I am not surprised by the decision they made to continue charging people for a service we can't use," said Kevin Tschirhart.

Earlier this week, New York Sports Club sent out an email outlining options to its members.

They said they would be issuing credits to accounts and "addressing all membership related concerns once gyms are operating."

Adding members need to contact the gym chain to freeze their account.

If they chose not to, their status would be promoted to elite once the gym reopens, giving them access to more facilities.

"I don't really care about an Elite Passport Membership, I don't need a Passport Membership. I want my money," added Lovitch.

State Attorney General Letitia James issued a letter Friday to the parent company of New York Sports Club saying, “New Yorkers have enough to worry about and should not be forced to pay for services NYSC is no longer providing. If NYSC refuses to do the right thing voluntarily, I will not hesitate to take every legal step necessary to protect New Yorkers from NYSC’s unlawful conduct and get their money back.”  

"I hope we don't get to that point, I hope New York Sports Club does the right thing," said Tschirhart.

Some members say they’re okay with the charge this month, but if it continues for several they will freeze their accounts.

"I dont mind being charged one month to support something that I find important. I still want the gym to be there when life returns to normal hopefully, so if that means helping with cash flow for a month or so I don't mind that," said Anthony Lucia.

We reached out to New York Sports Club for comment repeatedly but have not yet heard back.

Many members say, when it is safe to return to the gym they may be taking their business elsewhere.
