Judge: NYPD Can Order Breathalyzer For Officers Who Open Fire

A judge ruled this week the police department can require officers involved in shootings take Breathalyzer tests.

The mandate was put in place after the 2006 police shooting of Sean Bell, though three police unions sued to block the order.

The Detectives Endowment Association, Patrolman's Benevolent Association, and the Captain's Endowment Association argued making officers who shoot someone take a Breathalyzer test violates their constitutional rights.

Judge George Daniels said the police department has a "practical interest" in ensuring officers are fit for duty.
