Trial Begins For NYPD Officers Charged In '08 Rape

Opening arguments were delivered Monday in the trial of two New York City Police Department officers accused of raping a woman they were called to help.

The assistant district attorney called the actions of Officers Kenneth Moreno and Franklin Mata calculated and predatory since they were the ones who were supposed to be protecting the alleged victim.

Prosecutors say the officers escorted the woman, whom prosecutors say was drunk, to her East Village apartment in December 2008.

Moreno then allegedly raped the woman, while Mata acted as a lookout.

Authorities say the two returned to the victim's apartment three times that night.

Moreno's attorney says everything that happened between the officer and the woman was with her consent while she was conscious and able to speak.

He says her memory is not reliable because she was drunk.

The court also heard testimony from the officer who came to the scene after a complaint was made.

Both officers also face burglary and other misconduct counts.

The case will resume Tuesday morning.
