The Rossville mother of a 5-year-old battling a brain tumor is reacting after two Brooklyn residents have been arrested. They are accused of using her son's picture to collect donations.

The family of 5-year-old Gianni Incandela, set-up a GoFundMe page to raise money for his raditation treatment.

They found out another family likely took his picture from that page and allegedly claimed they were trying to raise money to help pay for his funeral even though he is still alive.

Lynbrook Police arrested 30-year-old Brittney Schmidt and 29-year-old Vincent Fina Friday night at their home.

Police say the couple, along with their son, went to several businesses on Merrick Road asking for donations.

The couple is charged with Scheme to Defraud and Endangering the Welfare of a Child. They were arraigned in Nassau County Saturday and released on probation. They're due back in court on March 7th.

The judge also ordered them both to get treatment for substance abuse.

"I feel like just being told, 'oh you're on probation,' isn't really going stop them. I think they will continue to do this again if something is not done, like more consequences," said Kelly Incandela, Gianni's mother.

Anyone who thinks they may have been scammed by the couple is asked to call police.
