NEW YORK - A group of transgender and gender-nonconforming individuals have filed a lawsuit against Texas Chicken and Burgers, alleging they were denied service based on their gender identities.

The group says that on May 27, a cashier at the fast food restaurant’s Harlem location refused to serve them, saying there was no chicken but didn't say that to the customer behind them.

The group gathered outside of the Stonewall Inn in Greenwich Village Thursday to announce the lawsuit, which claims sex discrimination and intentional infliction of emotional distress.

"It's just not fair, honestly - we didn't deserve that - we just wanted to go and grab something to eat and go back to our apartment," said Daniele Marino, a plaintiff in the lawsuit.

Texas Chicken and Burgers released a statement saying in part, "While we regret that our customer did not receive the level of service we would expect from all employees. We are confident that the situation was caused by an honest mistake made by the employee and not the product of any intentional discriminatory treatment as is portrayed in the video."
