SAN MARCOS, Texas - Hays County District Attorney Wes Mau on Thursday reported a grand jury has indicted Stewart Mettz in the fatal Dec. 4, 2017, shooting of San Marcos police officer Ken Copeland.

Mettz is facing a capital murder charge, which is punishable by death or life in prison without the possibility of parole.

Copeland in December was serving a warrant at Mettz’s home, located in the El Camino Real subdivision.

According to police, Mettz began firing at officers and Copeland was struck several times. Police described it as an ambush situation.

Mettz was taken to an Austin hospital with a gunshot wound. Copeland was pronounced dead.

Copeland was a 19-year veteran of the San Marcos Police Department and its first officer to die in the line of duty. He left behind a wife and four children.

In addition to the capital murder indictment, the jury returned an indictment for injury to an elderly person and retaliation. That indictment is in connection to an incident that occurred on or about Nov. 25, 2017. It corresponds to the allegations that prompted the warrant Copeland was attempting to serve.

“The indictment is just the first step in this process," Mau said in a statement. “While we at the DA’s office have every intention of seeing that justice is done for Ken Copeland, his family and friends, and the law enforcement community here in San Marcos and Hays County, there remains a long way to go.”
