NEW YORK - A city student was arrested Monday after police say he beat up a principal at his Manhattan high school.

Luis Penzo, 18, is charged with second degree assault.

Investigators say Principal Matthew Tossman of the Manhattan Early College School for Advertising saw Penzo with his headphones blasting on the ground and asked him to turn them down.

When Penzo refused, Tossman tried to remove the headphones from the floor.

That's when the teen punched Tossman in the head and face.

Tossman was treated for swelling and cuts at the hospital and released.

The school is located inside Murry Bergtraum High School in Lower Manhattan.
