Tom Brady's fate will be decided by a Manhattan judge, after failing to reach a settlement over the "Deflategate" scandal.
The New England Patriots quarterback and NFL Commissioner Roger Goodell failed to come to an agreement in court Monday.
The judge plans to deliver a ruling on Friday.
Brady is challenging his four-game suspension for his involvement in using under-inflated footballs during the AFC Championship game in January.
The four-time Super Bowl champion says he had nothing to do with the under-inflating of any footballs.
The Patriots first game of the season is next Thursday, September 10.
