The state's highest court reportedly rejects a lawsuit requesting files on the police officer who used a chokehold that killed a man on Staten Island.

The Legal Aid Society filed a motion in October to access the disciplinary record of Officer Daniel Pantaleo.

He's the officer who put Eric Garner in a deadly chokehold in July 2014.

Garner died after repeating "I can't breathe."

The incident was caught on video — and helped spark the nationwide Black Lives Matter movement .

The court gave no reason for its decision.

The Legal Aid Society commented on the decision, quote "This decision is regrettable but not a surprise given the leak of Officer Daniel Pantaleo's CCRB history earlier this year."

The ThinkProgress website published parts of Pantaleo's civilian complaint history in March, which they say was from an anonymous source who works at the Civilian Complaint Review Board.

Records showed he had seven prior complaints.
