ONEIDA, N.Y. -- State Police are trying to figure out exactly what happened, after a man died following an altercation with police in Oneida.

It happened Monday morning in front of the state police barracks on Route 5.

It was reported John Havener Jr., a 41-year-old of Vernon Center, was driving a vehicle erratically, which he parked on the roadway and got out of.

Police saying he was very combative and violent, and refused to get out of the road. He was allegedly also seen making threats, and waving his arms around.

They attempted to subdue him by shocking him with a taser, which they say didn't deter him. A second attempt was made and Havener was at that point subdued.

At that point they noticed that he was having trouble breathing and was then administered medical treatment.

Havener was declared dead after being transported to the hospital.

At this point, in adherence with executive order, the attorney general's office was alerted because this incident has resulted in the death of an unarmed civilian.

Authorities also refused comment on whether someone else was in the vehicle, but did say he was unarmed.
