RALEIGH -- The man responsible for the deaths of 2 people on I-40 Thursday night went before a Wake County judge Monday.

Anibal Ambrocio-Chicel, 27, was at the wheel drunk last Thursday when he struck a car head-on on I-40, while going the wrong way. 

Police say two people in the Honda Civic driven by Ambrocio-Chicel were killed abd two others in the car were taken to WakeMed.

Ambrocio-Chicel is facing up to 34 years in prison. 

However, immigration officials believe Ambrocio-Chicel may be a danger off the roads. ICE served the Guatemalan immigrant with a notice of detainment, saying he doesn't have the papers to stay in the county. 

For now he remains in state custody until his next court date. 

Steve Abbott, spokesman for the NCDOT says wrong-way crashes accounted for just 0.2 percent of all freeway crashes in North Carolina from 2000 to 2016.

"However, they are a very important issue because these crashes are usually at night and high-speed head-on crashes, hence the volume of fatalities and serious injuries," said Abbott.

Abbott also said just under half of the crashes are alcohol-related.
