The NYPD says they have a credible rape allegation against Harvey Weinstein and are gathering evidence for a possible arrest.

Chief of Detectives Robert Boyce said investigators have interviewed "Boardwalk Empire" actress Paz de la Huerta, who publicly accused Weinstein of raping her twice in her apartment back in 2010.

According to police, Weinstein is currently out of the state.

"But I will say we have an actual case going forward," Boyce said. "If this person was still in New York and it was recent, we would go right away and make the arrest, no doubt. But we're talking about a seven-year-old case, and we have to move forward, gathering evidence first."

A spokesperson for the Manhattan district attorney's office says a senior sex crimes prosecutor is assigned to the case, and they are working with the NYPD.

Weinstein has repeatedly denied allegations of non-consensual sex.
