Sources tell NY1 that the Civilian Complaint Review Board has found that the New York City Police Department officer accused of smashing a teenage boy through a store window last year used excessive force.

Javier Payne, 14, suffered cuts to his head and chest after the scuffle in the Bronx last May

His family says Sergeant Eliezer Pabon threw him through the window after he was already arrested and handcuffed.

Police Commissioner William Bratton spoke about the investigation exclusively with NY1.

"Allegation that a sergeant in the department had pushed a young man into a plate glass window, that matter has been acted upon by the CCRB, I understand," Bratton said. "At some point in time, it will get up to my office to be reviewed by me."

In November, the Bronx district attorney ruled not to prosecute Pabon for the incident. The DA concluded the window was compromised before the event and wasn't shatter-resistant.

Payne's lawyer said he is pleased with the board's findings.
