A man arrested in connection with the murder of a single dad in the Bronx has been released from jail because prosecutors don't have enough evidence to hold him any longer.

Back in February, police say 35-year-old Philip Roseburgh was beaten by at least two men in front of his building on Garden Street in the Belmont neighborhood.

Sources tell NY1, he argued with the men because they were selling drugs near his building and that's when he was punched, kicked, and knocked down.

He hit his head on the sidewalk. His injuries were so severe; he died a few days later. Police did arrest a man named Ceasar Johnson.

But NY1 has learned Johnson has been released because his case was not presented to a grand jury due to a lack of sufficient evidence.

Law enforcement sources tell NY1 there were several witnesses to the attack and they need to come forward to help convict Roseburgh's attackers.

The Bronx District Attorney's Office says the investigation is ongoing.
