The federal government has dropped its appeal against the release of a pizza deliveryman detained in Brooklyn.

Pablo Villavicencio was arrested and detained by Immigration and Customs Enforcement on June 1 after making a delivery to the Fort Hamilton Army base. 

ICE officials said Villaviciencio ignored a deportation order issued in 2010 after entering the country illegally.

Villaviciencio was released on July 24.

The government had 90 days to file an appeal. They did so earlier this week. It is not clear why they decided to drop the appeal.

Governor Andrew Cuomo released a statement on the reversal, saying, in part, "we stand with our immigrant community in the face of the federal government's un-American assault on immigrants."
