Update: Judge Greenwood ruled for Michael Rotondo to vacate his mother's home by June 1 at noon. 

Michael Rotondo, 30, entered court Tuesday morning and ended up sitting on the opposite side of his mother, Christina Rotondo.

That's because she filed court papers to evict him from her Camillus home.

"My clients don't really have to express a reason why they want the respondent to leave their residence," said Christina Rotondo's lawyer Anthony Adorante.

According to court documents Christina Rotondo and her husband Mark have provided multiple notices to Michael since February asking him to go.

“They have served [Michael] with a notice. One of 14 days, one of 30 days,” said Onondaga County Supreme Court Justice Donald Greenwood.

They even offered to give him $1,100 and help find him a new place to live. Michael says he used the money on other expenses.

"I'm not a burden to them in the home. They don't provide laundry or food," said Michael Rotondo.

Michael argued he should have been given six months’ notice before being ejected.

“I just want a reasonable amount of time to vacate with consideration of the fact that I was not really prepared to support myself at the time when I was served these notices,” Michael said.

Ultimately the judge ruled in his mother's favor.

“I'm granting the eviction. I think the notice is sufficient,” said Greenwood.

“I don't see why the judge wants to throw people out on the street,” Michael said.

Michael Rotondo says he doesn't know where he plans to move, or what he's going to do with his belongings. But, he does plan to appeal the case.
