No criminal charges will be filed in the death of an emotionally disturbed Bronx man who was tased three times by police in November.

According to the report released by the Attorney General's Special Investigations and Prosecutions Unit, Ariel Galarza refused police orders to lie down and drop a 12 ounce glass bottle.

Police tased him once, then twice more in the course of a struggle before eventually restraining him, according to the report.

After he was handcuffed, Galarza lost consciousness and was pronounced dead at the hospital.

Sanford Rubenstein, the attorney for the family, says they plan to file a civil suit.

"A jury in the Bronx will ultimately decide the culpability of the NYPD and these police officers, particularly this police sergeant for the wrongful death of Ariel Galarza. He wasn't just tasered once. He was tasered three times, twice after he was disabled and dropped the bottle," Rubenstein said.

"This has to stop. Too many people are dying. Something has to be...someone has to be held accountable. Things need to start rolling so these situations don't get out of control and we continue to lose innocent lives," said Jeanette Galarza, Ariel's sister.

The Medical Examiner and an independent expert both concluded the cause of death was a pre-existing heart condition, drug intoxication and obesity combined with the effects of physical exertion, restraint, and the taser.
