Local labor and immigration advocates are calling for the release of a Guatemalan immigrant.

Teamsters Local 813 held a rally in TriBeCa with the family of Eber Garcia-Vasquez.

They say the Long Island resident was detained last Thursday, when he checked in with immigration officials.

His family says he's been living in the United States for more than three decades, and his wife and children are American citizens.

They say ICE wants to deport him before he can become a citizen as well.

"He is a good man. He's a hard-working man. He checks in, and for him to check in and for him to be in jail is not right," said Aroy Garcia, Garcia-Vasquez's daughter.

"This should not have happened. It was arbitrary. And especially the fact he has a path to stay in ths country," said Angela Fernandez, executive director of the Northern Manhattan Coalition for Immigrant Rights. "He has a U.S. citizen wife, three U.S. citizen children. Fifteen years through a mortgage, he's halfway through paying a mortgage with his wife. And to be taken away from his job and from his family is something that's very unjust."

Garcia-Vasquez's attorney says he had not been flagged for deportation in the past because he has a clean criminal record.
