The Daily News is reporting that the federal Justice Department has started to present evidence to a grand jury in the death of Eric Garner.

According to the Daily News, the federal grand jury will determine if Garner's civil rights were violated.

Sources tell the Daily News that two officers who were present during the incident were called before the grand jury.

Garner died in July 2014 after being put in a chokehold by NYPD Officer Daniel Pantaleo. The officer was trying to arrest him on suspicion of selling loose cigarettes. 

Pantaleo was not indicted by a local grand jury for his part in Garner's death, but he could face federal civil rights charges.

Pantaleo has been on modified duty since the incident. His lawyer, Stuart London, declined to comment on the story to NY1.

The NYPD has been asked to hold off on moving forward with its own investigation until the government has wrapped its inquiry.
