Queens District Attorney Richard Brown says the mother of the child who was left in a manger at a church in Richmond Hill will not be prosecuted after authorities were able to locate and interview her.

Brown says the mother followed New York State's "Safe Haven Law." The law allows a parent to leave a newborn baby no more than 30 days old in a location such as a fire station or a church, so long as they notify someone of the child's location.

According to Brown, the mother felt that the child would be found in the church and left the baby in the manger because it was the warmest place in the church.

Brown also says the mother returned to the church Tuesday morning after leaving the child to make sure the baby had been found.

Police say the infant was wrapped in blankets, and his umbilical cord was still attached, when a custodian found him in the church on Monday.
