The family of Derrick Griffith, one of the eight people killed in last week's deadly train derailment, plans to file a lawsuit against Amtrak.

The Bronx native was the dean of student life at Medgar Evers College in Brooklyn. 

Griffith was also getting ready to graduate with his PhD at the end of this month. 

The family says a lawsuit is coming, but right now they need time to grieve. 

"I never told him this, but he's everything I wanted to be. I never thought I was smart or strong enough. How he could come into a room and captured everybody's smile and be loved," said his brother, Darryus Griffith.

"Darryus was four-years-old. He raised Darryus, single handedly, and spent the last 13 years bettering himself and just received his PhD," said Steven Schwartzapfel.

While the investigation into what caused the deadly crash is still ongoing, other lawsuits have already been filed by victims of the crash. 

The family says Griffith's final resting place will be at Woodlawn Cemetery in the Bronx.
