The city Board of Elections says it is fully cooperating with the federal Justice Department, which last week accused the agency of breaking federal law.

The board's executive director says the federal intervention was not unexpected.

The Justice Department last week sought to join a lawsuit against the BOE, arguing the agency did not take the proper steps before removing nearly 120,000 Brooklynites from voter rolls last year.

Most of them had not voted since 2008.              

"I anticipate, as has been the track record with the Department of Justice in the past, that we will work cooperatively with them, and come to a resolution," said BOE Executive Director Michael Ryan.

Meanwhile, the Board says it is still evaluating whether it wants to bring the old lever machines out of retirement for any potential runoff elections later this year.

Runoffs would take place two weeks after the September 12 primary, which the board says is not enough time to reprogram and test its electronic scanning machines.
