The NYPD officer convicted of assaulting a man during an arrest has been fired from the department.

It comes after a judge sentenced Joel Edouard to two years probation for stomping on a man's head while he was being arrested in Brooklyn in July of 2014.

The incident was recorded on a cellphone.

Officers said Jahmi-El Cuffee was resisting arrest for allegedly smoking marijuana and drinking in public.

However, the judge ruled Edouard's actions amounted to police brutality.

His lawyer, Anthony Ricco, says the decision is too harsh.

"People make mistakes. They use poor judgment," Ricco said. "This is not a case where a person was murdered, killed, choked to death on the street, shot in a bathroom. None of those officers faced any departmental charges. We have this hard-working police officer, member of our community who kicked somebody, and he's fired, convicted and fired, and it's a loss for our community."

Edouard was suspended without pay after his conviction.

His firing comes after the NYPD conducted a departmental trial.
