The man accused of murdering a baby in Utica appeared in City Court.

Jason Nieves, 20, is facing a second-degree murder charge for allegedly murdering his girlfriend's 7-month-old baby.

Police were called to a home on Walker Street Saturday evening for an unresponsive baby.

Emelina Sanchez, was found with faint vital signs and possible injuries to her head. 

She was taken to a local hospital and then transferred to Golisano Children's hospital in Syracuse, where she later died.

Police said Nieves was babysitting Emelina Sanchez and caused injuries to her head that led to her death.

"Well obviously, this type of, this type of incident is disturbing to everybody involved, and you know, it's as sad as it gets. And any loss of life taken by another human is uncalled for," said Utica Police Lieutenant Bryan Coromato.

In court, Nieves waived his right to a preliminary hearing.

He's being held without bail.
