Attorney For Alleged Subway Pusher Seeks Witnesses

The attorney for a man accused of pushing another man off a subway platform to his death is reaching out to witnesses who might be able to clear his client.

Steven Pokart, Naeem Davis' lawyer, is passing out flyers at the 49th Street Station, where the incident happened last week.

Police say Davis pushed Ki-Suck Han onto the tracks, where he was hit and killed by an oncoming Q Train.

But Pokart says Han had been drinking and was harassing his client.

"If my client, in fact, pushed him in fact to get Mr. Han away, that's kind of normal behavior," Pokart said. "Unfortunately, it was in the subway, and unfortunately, the platform was only nine feet, seven inches wide. Perhaps he pushed him too hard, or perhaps he pushed him not too hard and Mr. Han, being drunk, couldn't keep his feet."

Davis faces second-degree murder charges.
