Monserrate's Lawyers Claim Grand Jury Was Tainted

State Senator Hiram Monserrate's lawyers reportedly want his assault indictment thrown out because a police officer who was on his grand jury works in the precinct that investigated him.
According to a report in today's Daily News, one of the officers who testified before the grand jury told Monserrate's lawyers he recognized a fellow officer from the 105th Precinct on the panel.
According to the paper, a private investigator working for Monserrate says when the officer who testified told prosecutors about the possible conflict, they told him not to worry about it.
Monserrate is accused of slashing his girlfriend Karla Giraldo with a broken glass during an argument last December. Both now claim the injury was accidental.
