Deliberations were delayed Monday in the case of Janet Mercereau, who is accused of murdering her fire marshal husband in their Staten Island home, as defense attorneys asked to reopen evidence.
Earlier in the day, defense attorneys asked the judge to reopen the evidence to hear more testimony about a picture of Mercereau at K-Mart the night before her husband Douglas was shot in December 2007.
Prosecutors claim there was no mark on Janet Mercereau's hand before the murder and say she had a mark on her hand at the precinct because she was burned by the gun.
But the defense says K-Mart surveillance shows she had the mark on her hand before the murder and did not get it from firing a gun.
Prosecutors say Janet Mercereau shot her husband Douglas to death inside their Oakwood home.
Investigators say he was killed with his own gun.
Janet Mercereau has maintained that although she was in the house at the time, she had nothing to do with the killing and did not hear any gunshots because she was sleeping with earplugs.
Jurors have been sequestered overnight and will resume deliberations in the morning.
