Only 65 votes separate the two candidates for the upstate congressional seat once held by Senator Kirsten Gillibrand.
Democrat Scott Murphy holds a slight lead over Republican Jim Tedisco in the race for the 20th Congressional District seat.
But there are more than 10,000 absentee ballots still to be counted.
Republicans have already filed a lawsuit asking that paper ballots be impounded, which is normal for a close race.
The seat has been vacant since Gillibrand was appointed to replace Secretary of State Hillary Clinton in the United States Senate.
