Ex-Wife Again Denies Involvement In Slaying Of Orthodontist

The Queens doctor accused of arranging the murder of her ex-husband once again denied her involvement in the orthodonist's death Thursday, before both sides rested their cases.

Dr. Mazoltuv Borukhova, 35, is charged with conspiring with her uncle to kill her ex-husband, orthodontist Daniel Malakov, two years ago.

When asked about what she saw the day her ex-husband was murdered, Borukhova responded, “I didn’t hear or see anything.”

Malakov was gunned down right outside a Forest Hills playground in October 2007, while handing over the couple's daughter for a supervised visit.

While in court Thursday, prosecutors replayed video of the night Borukova transferred custody of her then-four-year-old daughter.

They asked her to confirm that it was the voice of her mother in the background, who according to prosecutors, said in Russian to Borukhov, “When you’re dead and in the grave, I hope your body will be moved from cemetery to cemetery.”

On Wednesday, prosecutors used medical records to try to counter Dr. Borukhova's claims that she had nothing to do with her former husband's murder.

The doctor claims she made dozens of phone calls to her uncle, accused gunman Mikhail Mallayev, in the days before the October 2007 shooting because she treated him and his wife for heart problems that month. But prosecutors produced EKG readings that were dated August 2006, rather than October 2007.

Prosecutors say Borukhova paid Mallayev $20,000 to kill her husband after losing custody of the girl.

"She's a professional liar," said Malakov's father, Khaika Malakov. “She has [an] ice heart.”

"She did it," added Malakov's mother.

Mallayev's attorney, Michael Siff, said Borukhova's testimony did not affect his client's case.

“Our client denies any culpability,” said Michael Siff, Mallayev’s attorney. “I don’t think Borukhova’s testimony has any effect on him at all. The people have the burden of proof, he has no obligation to testify, he denies being present as he always has.”

Both sides of the trial rested their cases Thursday. Summations are scheduled to begin Friday morning.

Borukhova and Mallayev are on trial on murder and conspiracy charges and face life in prison.
