Opening Arguments Heard In Orthodontist Murder Trial

Opening arguments were heard Wednesday in the murder trial of a woman accused of orchestrating the murder of her husband.

Dr. Mazoltuv Borukhova is facing murder and conspiracy charges in the death of orthodontist Daniel Malakov.

Malakov was killed at the Annadale Playground in Forest Hills in 2007 in front of the couple's four-year-old daughter – who was at the center of a custody battle.

During his opening argument, prosecutor Brad Leventhal said that Borukhova paid her uncle, Mikhail Mallayev, $20,000 to shoot her husband because she was upset over losing custody.

The shooting happened six days after the hearing ended.

"She accomplished in one moment with a payment to an assasin what she couldn't do with payments to her attorney," said prosecutor Brad Leventhal during his opening argument.

Mallayev has been charged with murder. The prosecution tried to paint Mallayev as a cold-blooded killer.

Both suspects claim they are innocent.

Mallayev's attorney says his client is a family man that did not need the money. He instructed the jury not to lump Mallayev and Borukhova together.

Borukhova's attorney, Stephen Scaring, also delivered opening remarks Wednesday afternoon.

Family members of both the victim and the defendants were in court but did not address the media.

The trial is expected to last about five weeks.
