Incoming Senator Monserrate Resigns From City Council

Democratic Queens politician Hiram Monserrate resigned from the City Council on Wednesday night to prepare to take his State Senate seat.

The resignation was effective one minute before midnight on New Year's Eve and allows Monserrate to take his Senate seat next week.

Monserrate faces second-degree assault charges, after allegedly slashing the face of his girlfriend, Karla Giraldo, with a piece of broken glass last month, leaving her with a gash that required 20 stitches.

He claimed he cut his girlfriend after he tripped while holding a glass of water.

Last month, State Senator Martin Golden and other Republican senators proposed a resolution to block Monserrate from taking his seat until the charges are resolved.

If convicted, Monserrate would have to resign immediately and face seven years in prison.

The Democratic Party’s tenuous hold on the State Senate has been further complicated by three renegade Democrats who are refusing to back their party's leader, Malcolm Smith.
