Lillo Brancato had what was described as a promising acting career, but now he could be on the verge of spending the rest of his life behind bars in connection with the shooting death of an off-duty police officer.
On Tuesday, prosecutors and defense lawyers gave their closing arguments in the murder and burglary case.
"His life hangs in the balance, so right now he is incredibly tense and scared to death," said Defense Attorney Joseph Tacopina.
Brancato had roles in a few movies including "A Bronx Tale." The 32-year-old has admitted that he was high on drugs in December of 2005 when he and Steven Armento tried to get prescription pills from another friend's apartment on Arnow Place. After hearing a window break, officer Daniel Enchautegui, who lived next door, came out.
Shots were fired and the officer was killed, but he was able to shoot and wound Brancato and Armento.
Armento has already been convicted of murder for firing the shot that killed Enchautegui.
Brancato's defense team said he knew nothing about a gun and was not trying to break into the apartment.
"The facts are very simple, Lillo Brancato did not try to commit a burglary. If he did try to commit a burglary, this case is over," said Tacopina.
Terry Gottlieb is the assistant district attorney on the case. During her closing arguments she waved around the 357 magnum used to kill the officer. Gottlieb said Brancato knew his friend had the weapon.
Prosecutors have to prove the pair were acting in concert to burglarize the apartment. To find Brancato responsible for the murder, the jurors must first find him guilty of burglary.
"We hope the jurors look at just the facts of this case, nothing more, nothing less," said PBA President Pat Lynch. "He proved to us all, he is selfish and a junkie willing to do anything to get drugs and cause the death of a police officer."
Now that all of the evidence is in and closing arguments wrapped up, the jurors will now deliberate over the fate of Lillo Brancato.
