Testimony began Tuesday in the murder trial of Lillo Brancato, who is being charged in the 2005 killing of off-duty Bronx Officer Daniel Enchautegui.
The former actor, who appeared in films like "A Bronx Tale," faces second-degree murder charges.
During opening arguments, prosecutors said Brancato, 32, and codefendant Steven Armento were attempting to steal prescription drugs from a home in Pelham Bay when Enchautegui, who lived next door, confronted them.
In its opening statement, the defense said all the blame belongs to Armento, who was convicted last month and sentenced to life in prison.
Brancato's lawyers admitted their client was a drug addict looking for prescription drugs but say he never entered the apartment, only broke the apartment window, and did not know Armento had a gun and he did not have one himself.
"He didn't have a gun. He has never been alleged to have a gun," said Brancato's attorney, Joseph Tacopina. "He never committed a crime for violence."
Prosecutors say that Brancato knew Armento had a gun because Armento had pulled it on a drug dealer earlier the same night.
The police union says Armento and Brancato are both to blame.
"They are both responsible here," said Patrolmen's Benevolent Association President Pat Lynch. "Despite the bombastic sludge the attorney put forward today, these slugs should be found guilty like Armento was in the first trial. Because you are a junkie and you think you have a problem, does not give you the right to take the life of a New York City police officer."
Defense attorneys say they have not decided if Brancato will take the stand in his own defense. They have a while to decide that, as they expect this trial to last at least three weeks.
