Nixzaliz Santiago, who was convicted last month of first-degree manslaughter and assault in connection with the death of her seven-year-old daughter, was sentenced to the maximum consecutive sentence Wednesday.
Santiago will serve 43 years in jail for her involvement with the death of Nixzmary Brown in January 2006.
The Brooklyn mother showed no emotion in the courtroom and when she was given the chance to speak showed no remorse.
Santiago was also found guilty of unlawful imprisonment and endangering the welfare of Brown, but was acquitted of the most serious charge of murder.
Judge Patricia DiMango told Santiago, “If it were not for your failure to act, Nixzmary would have probably not died from that blow on that day.”
“For little Nixzmary Brown, it’s not just about what was done to her, the abuse and the torture and how she was forced to live,“ said prosecutor Ama Dwimoh. “What it clearly states and tells every parent and guardian – it’s not just that. You have a duty to your children. Yes, children do in fact come first.”
During her trial, defense attorneys argued the girl's stepfather Cesar Rodriguez was to blame for her death.
He was found guilty of manslaughter earlier this year and is currently serving 29 years behind bars.
“In 29 years, Cesar Rodriguez is going to be walking the streets, eating hamburgers, drinking sodas and hanging out with his family,” said defense attorney Sammy Sanchez. “And the mother, who didn’t even touch that kid once, is going to be in jail for 43 years, and he’s going to be out of jail in 29 years. Where do you see justice there? I don’t see it.”
Santiago's lawyers intend to appeal and ask for a reduced sentence.
An order of protection remains in place, restricting Santiago from any contact with her five surviving children.
