A fire department emergency medical services captain testified that the woman accused of killing her fire marshal husband was allegedly drinking during police questioning.

In Staten Island Supreme Court Wednesday, the captain said Janet Redmond-Mercereau had three shots of scotch as officers questioned her about her husband's death last December.

Douglas Mercereau was shot three times by his own gun in his home in Oakwood on December 2.

His wife is facing charges of second-degree murder along with counts of tampering with evidence and weapons possession.

Her lawyer said the police had offered her the alcohol.

Redmond-Mercereau told police last year that she was in her daughters' bedroom and did not hear the gunshots because she had on earplugs. She denies any involvement in his death.

The couple's children are currently living with their uncle.
