Lawyers are appealing a judge's ruling against the Serbian student detained on suspicion of beating a fellow Binghamton University student.
Attorneys for Miladin Kovasevic said Wednesday that they are fighting the decision to keep him in prison for at least 30 days pending an investigation.
He was detained Tuesday on suspicion of inflicting "life-threatening bodily harm" on Brooklyn student Bryan Steinhauer during a bar fight in May.
Kovasevic fled the United States after the incident, leading to a protracted battle to get him returned to face charges.
Steinhauer is slowly emerging from a coma, but remains hospitalized.
