Nixzmary Brown's Death Scene Described In Trial

Pictures of seven-year-old Nixzmary Brown's beaten body were shown to the jury Friday as testimony began in her mother's murder trial.

Brooklyn resident Nixaliz Santiago wept in court as the 2006 death of her daughter was described by an eyewitness police officer before a jury.

Authorities say Brown died while being punished for stealing yogurt.

Prosecutors accuse Santiago of ignoring her dying daughter's pleas for help.

"She had opportunity upon opportunity, and she was consciously aware and disregarded the risk the Nixzmary could end up with serious physical injury or death," said prosecutor Ama Dwimoh.

The defense portrayed Santiago as a victim, who stayed with her violent husband because she did not want to return to the city's shelters.

"She didn't know [Brown] was dying,” said defense attorney Sammy Sanchez. “When she walked into the room and she saw Nixzmary Brown, she had injuries but those injuries were pre-existing injuries so she had no reason to know that she was dying."

Nixzmary's stepfather, Cesar Rodriguez, was convicted of manslaughter earlier this year.
