Charges Could Be Upgraded For Driver Who Struck Traffic Agent

The driver in the accident that killed a pregnant traffic agent earlier this month could face new charges, following the death of the agent's baby on Friday.

Sean Michael Sanz died at New York Presbyterian Hospital.

Sanz was delivered by Caesarean section on August 14th after his mother, Donnette Sanz, was struck by a van, which sent her into the path of a school bus.

Thirty bystanders lifted the bus off her, but she died after the baby was born.

Prosecutors say they will wait until the medical examiner determines the cause of Sean's death before they decide whether to upgrade charges against

Walter Walker, 72, who was driving the van, is already charged with criminally-negligent homicide and driving without a license.

The Bronx District Attorney's Office said that it will await the results of the medical examiner's report on the infant's death before deciding whether to upgrade the charges.

Neighbors who are dealing with Donnette Sanz's death said they were devastated to learn her baby had also died.

"This is devastating. We were all calling him the miracle baby, especially after surviving what happened with his mom," said one neighbor. "And then for this to happen, I actually thought the baby was going to pull through on this one, you know? I was shocked. It was a shock."

"It's sad. It's very, very sad," said another. "This family must be so, so destroyed, you know?"

Funeral services for Donnette Sanz will be held Monday morning in the Bronx. Relatives say the baby will be buried with his mother.
