Family Of Boy Killed By Tractor Trailer To File $50M Suit Against City

The family of a boy hit and killed by a tractor trailer in East Harlem is planning to sue the city for $50 million.

Amar Diarrassouba, 6, was struck at First Avenue and 117th Street on February 28 while walking to school with his older brother.

Court documents show that the family filed a notice of claim with the comptroller's office on Thursday, the first step in pursuing a lawsuit.

The notice names the city, the New York City Police Department and crossing guard Flavia Roman as defendants.

Police say Roman was assigned to the intersection but was not at her post when the accident happened.

She has been suspended.

The New York City Law Department said it sympathizes with Diarrassouba's family and will review the claim.

The boy's family also filed a lawsuit in New Jersey against the truck driver and the company he works for, accusing them of negligence.

The driver received two tickets after the accident for failing to use due care and failing to yield to a pedestrian.
