An indictment was handed up Wednesday in the death of 6-year-old Etan Patz more than 30 years ago.
The Manhattan district attorney's office says a grand jury has decided to charge Pedro Hernandez, 51, with two counts of second-degree murder and one count of kidnapping.
He is due in court Thursday.
Hernandez's attorney released a statement, saying his client is mentally ill and has a history of hallucinations.
However, the Manhattan district attorney's office believes the evidence is credible and persuasive and the crime is not the product of mental illness.
Authorities say Hernandez confessed in May to killing Etan back in 1979.
Police have spent months trying to corroborate Hernandez's confession.
Etan disappeared while walking to school near his SoHo home, and his body has never been found.
