David Mitchell has been indicted on charges in connection with last week's rape of a woman in Central Park, prosecutors announced Wednesday.
The indictment will be unsealed when Mitchell is due back in court on October 9.
Mitchell is accused of attacking a 73-year old birdwatcher in broad daylight near Strawberry Fields.
It happened just a week after authorities say Mitchell spotted the woman taking photos of him as he exposed himself.
Mitchell, who is homeless, has a lengthy criminal record.
Authorities in West Virginia say he was acquitted of a murder charge two years ago and was a "person of interest" in an unsolved homicide.
