Charges against a man accused of attacking a school bus driver are expected to be upgraded now that the driver has died from his injuries.

Joey Scott is currently facing assault charges for the alleged attack on Juan DelValle.

Police said the 65-year-old DelValle was driving a school bus on Anthony Avenue in the Bronx on June 11 when he accidentally hit Scott's car.

Investigators said Scott then attacked DelValle and took off.

DelValle was taken to the hospital and died Friday night.

The medical examiner ruled DelValle's death a homicide because of blunt force trauma to the head.
