Family Of Hit-And-Run Accident Victim Files Civil Lawsuit

The family of a Staten Island grandmother killed in a hit-and-run accident last month has filed a civil lawsuit.

An attorney for Clara Almazo's family says a civil lawsuit was filed last week against the man allegedly driving the car, Brian McGurk, as well as the New York Mets and a local bar.

The suit claims McGurk drank too much during a Mets game on April 5 and then continued drinking at the Nuremberger Bierhaus in West Brighton before getting in his car.

McGurk allegedly hit and killed Almazo while she was walking home from Holy Thursday Mass with her grandson.

Witnesses say she selflessly pushed the boy out of the way before the crash and the child sustained a broken leg.

McGurk has pleaded not guilty to charges of leaving the scene of an accident.
