Dominique Strauss-Kahn has asked the court to dismiss his accuser's civil complaint.
The former International Monetary Fund chief said he has diplomatic immunity from the sexual assault lawsuit filed by hotel maid Nafissatou Diallo.
Prosecutors dropped criminal charges against him after questions were raised about her credibility.
Strauss-Kahn has since returned to his native France.
In an interview on French television last week, he said the incident in the Midtown hotel in May was a "moral failing" on his part that did not involve violence.
