An off-duty New York City Police Department officer accused of raping a teacher in Upper Manhattan was indicted Wednesday by a grand jury.
Prosecutors say Michael Pena's case is being moved to state supreme court, where he will be arraigned a second time on September 21.
The 27-year old officer was arraigned over the weekend on rape and other sexual assault charges.
He is still being held on $1 million bond.
Authorities say Pena was drunk when he approached a 25-year-old woman Friday morning in Inwood and asked for directions.
They say he showed her his gun, forced her into a nearby backyard and raped her.
Pena's lawyers say he did not mean to harm anyone.
He has been suspended from the NYPD without pay.
