The straphanger hailed as a hero after helping to subdue a man accused in a deadly stabbing spree, is now planning to sue the city because he claims police could have done more to prevent his injuries.
A lawyer for Joseph Lozito says his client was appreciative of the officers who came to his rescue after being stabbed six times, allegedly by Maksim Gelman, seen above.
A grand juror told Lozito that a police officer testified that officers saw Gelman approach Lozito, but did not act quickly enough, even after seeing Gelman with a blade in his hand as other riders called for help.
Lozito took down Gelman with a leg sweep before police came out and apprehended the suspect.
Gelman is accused of killing four people and wounding four others during his 28-hour rampage through Brooklyn and Manhattan last month. He is due to be arraigned on murder and other charges next month.
